1. Acceptance of Terms

By downloading, installing, or using PumpCast ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PumpCast is a mobile application that transforms spoken podcast audio into workout-friendly audio by adding music beats underneath the speech. The service includes:

• Audio file upload and processing
• Genre-based beat generation
• Audio playback with offline capability
• Subscription-based premium features

3. User Accounts

Account Creation

To use certain features, you must create an account using Sign in with Apple. You agree to:

• Provide accurate information
• Maintain the security of your account
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Free Tier

The free version includes:

• Up to 3 stored podcasts
• 2-hour maximum podcast duration
• 2 hours monthly processing quota
• 30-second preview clips

Pro Subscription

The Pro subscription ($4.99/month or $39.99/year) includes:

• Unlimited podcast storage
• 3-hour maximum podcast duration
• Unlimited processing
• 60-second preview clips
• Priority processing queue

Billing

• All purchases are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled
• You can manage or cancel subscriptions in your Apple ID settings
• Refunds are handled according to Apple's refund policies

5. User Content

Your Content

You retain ownership of all audio files you upload ("User Content"). By uploading content, you grant us a limited license to:

• Process your audio files
• Store processed files
• Deliver content back to you

Content Restrictions

You agree not to upload content that:

• Infringes on third-party intellectual property rights
• Contains illegal material
• Violates any applicable laws

Content Responsibility

You are solely responsible for ensuring you have the right to use and process any audio content you upload.

6. Intellectual Property

Our Property

The App, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer the App
• Remove any proprietary notices

Generated Beats

The music beats generated by PumpCast are provided for personal, non-commercial use only. The processed audio files are for your personal listening and may not be commercially distributed.

7. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App or servers
• Use automated means to access the App
• Impersonate others or misrepresent your affiliation
• Upload malicious code or content

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The App will be uninterrupted or error-free
• Processing results will meet your expectations
• All audio formats will be supported

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount paid for the subscription in the prior 12 months

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through:

• Good faith negotiation
• Mediation
• Binding arbitration (if required)
